Terms of Service

Welcome to SpeechTherapyMagic. These Terms of Service (“Terms”) govern your access to and use of the SpeechTherapyMagic website, applications, and services (collectively, the “Service”). By creating an account or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using SpeechTherapyMagic, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization (such as a school or clinic), you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

SpeechTherapyMagic is an online platform that provides game-based speech therapy practice tools, AI-generated speech therapy content, and progress tracking dashboards for speech-language pathologists, parents, and children. The Service is intended to supplement, not replace, professional speech therapy services provided by a licensed speech-language pathologist.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when creating your account and keep this information current. You agree to notify us immediately of any unauthorized access to your account.

Child profiles must be created by a parent, legal guardian, or authorized SLP. You represent that you have the legal authority to create profiles and consent to data collection for any child profile you add to the Service.

5. Subscriptions and Payment

Certain features of the Service require a paid subscription. By subscribing, you agree to pay the applicable fees as described on our pricing page. Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date.

All fees are in U.S. dollars. We reserve the right to change our pricing with 30 days' written notice. Price changes will not affect your current billing period. Refunds are handled on a case-by-case basis; please contact our support team for refund requests.

6. Free Trial

We offer a 7-day free trial for new users. No credit card is required to start a trial. At the end of the trial period, you may choose to subscribe to a paid plan. If you do not subscribe, your access will be limited to free-tier features. Your data will be retained for 90 days after the trial ends.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to any part of the Service or its related systems
• Share your account credentials with unauthorized parties
• Use automated tools (bots, scrapers) to access the Service without written permission
• Reproduce, distribute, or create derivative works from our content, games, or materials without authorization
• Use the Service in any way that could harm, disable, or impair its availability to other users

8. Intellectual Property

All content, games, designs, logos, and software that make up the Service are owned by SpeechTherapyMagic or its licensors and are protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

AI-generated content (stories, word lists, worksheets) created through your use of the Service may be used by you for personal or professional speech therapy purposes. You may print and share this content with students and families as part of therapy activities.

9. Privacy and Data

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information and your children's information. By using the Service, you consent to the practices described in the Privacy Policy.

10. Termination

You may cancel your account at any time from your account settings. We may suspend or terminate your account if you violate these Terms or engage in conduct that we reasonably believe is harmful to other users or to SpeechTherapyMagic. Upon termination, your right to use the Service will cease immediately. You may export your data before termination, and we will retain your data for 90 days after account closure.

11. Limitation of Liability

To the maximum extent permitted by law, SpeechTherapyMagic shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service. Our total liability for any claims arising from these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim. The Service is provided “as is” without warranties of any kind, either express or implied.

12. Changes to These Terms

We may modify these Terms from time to time. We will provide notice of material changes by posting the updated Terms on this page and updating the “Last updated” date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which SpeechTherapyMagic is headquartered, without regard to conflict of law principles.
